TERMS AND CONDITIONS.

BY PLACING YOUR ORDER YOU CONFIRM YOU HAVE READ AND UNDERSTOOD ALL THE BELOW.

1.  SCREEN MONKEY CONDITIONS APPLY:

Unless specifically agreed in writing by Screen Monkey all quotations & contracts for the supply of goods by “Screen Monkey” are made upon these Conditions of Sale (“Screen Monkey Conditions of Sale”), which shall at all times override any terms & conditions which the purchaser of goods (“the Purchaser”) imposes or seeks to impose. Orders are accepted subject to the Company’s Conditions of Sale.

 

2.  ACCEPTANCE OF ORDER

Acceptance & the completion of the contract between you & “Screen Monkey” will take place on confirmation of your order, unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions set out in our Code of Conduct – Your Right to Cancel. Non-acceptance of an order may be a result of one of the following: product ordered is unavailable from stock and/or manufacturer, our inability to obtain authorization for your payment &/or the identification of a pricing or product description error.

 

3.  PAYMENT TERMS:

Terms of payment are strictly net. If payment is being made by cheque (without a valid cheque guarantee card) “Screen Monkey” reserves the right to withhold delivery until the cheque has cleared. In the event of a cheque being returned by the “Purchaser’s” Bank for any reason “Screen Monkey” shall be entitled to charge the “Purchaser” interest on any unpaid amount at the rate of 8% above the Bank of England’s base rate until full payment is made. The “Purchaser” will indemnify “Screen Monkey” in respect of all costs incurred by “Logo-Co” in recovering payment: including, legal fees/charges as well as any Bank charges incurred by “Screen Monkey”. Payment must be made upfront before the order goes ahead.

 

4.  PRICES:

The price payable for the goods you order is as set out on our website at the time of ordering or, if you order from one of our catalogues, as set out in the catalogue from which you order (this must be current & valid). Prices do not include carriage which will be added at the checkout/final invoice stage (if applicable). 

Prices are correct at the time of publishing & may be subject to change without prior notice.

5.  LOGO / BRANDING:

You "purchaser" aknowledge that you have full undisputed permission and rights to reproduce the logo you have supplied and requested to be branded onto all items supplied by Screen Monkey.

6.  TITLE OF GOODS:

Legal title of goods passes to the “Purchaser” when “Screen Monkey” has received payment in full although the risk therein passes to the “Purchaser” at the time of delivery.

7.  DELIVERY:

Terms & conditions for delivery are applicable in the UK only. For delivery outside the UK please contact our Sales Department. “Screen Monkey” will endeavor to meet any delivery date quoted, however, dates are given & intended as an estimate only. “Screen Monkey” shall not be held responsible for any delay in the delivery of goods howsoever caused, nor shall it be liable for any damage, consequential loss or expense arising from failure to deliver goods by a due date. Claims for shortages or damaged goods must be received in writing by “SW” within 3 days of the receipt of goods. The “Purchaser” must ensure (on delivery) that goods are signed for as damaged or incomplete, failing which “Screen Monkey” will not be liable in respect of any such claim & goods shall be deemed to have been delivered in a complete & satisfactory condition. Claims for non-delivery MUST BE MADE IN WRITING TO BOTH “SW” & THE CARRIER & should be received by “Screen Monkey” within 14 days of ordering.

8.  LIABILITY:

The following terms apply except in the case of death or personal injury caused by “Screen Monkey” negligence: Risks in the goods pass to the Purchaser on delivery & “Screen Monkey” shall not be liable for any loss, damage or deterioration of goods howsoever caused. The Purchaser shall keep “Screen Monkey” fully indemnified against all loss &/or liability arising from any such loss, damage or deterioration. If loss, damage or deterioration (except for death or personal injury) is caused by “Screen Monkeys's” negligence, “Screen Monkey's” liability shall be limited to the invoice value of the goods. All conditions & warranties regarding the quality & fitness for any particular purpose of goods supplies (whether statutory or otherwise) are expressly excluded but (without prejudice) every care will be taken to ensure goods supplied will conform to “Screen Monkey's” standards or specifications (within the limits of reasonable commercial tolerance & accuracy). If “Screen Monkey” identifies that goods supplied do not conform to its standards or specifications “Screen Monkey” will, in assessing the value of any allowance or replacement it may agree to make, have regard to the nature/extent of the defect, information given by the Purchaser regarding it’s application, the use already made of the goods & any other relevant factor. In any event “Screen Monkeys” maximum liability shall be limited to the invoice value of the goods. “Logo-Co” accepts no liability for any damage to property or consequential loss attributed to the failure of goods supplied, whether due to abuse, accident or incorrect technical assessment by “Screen Monkey” or its employees or for any other reason.

9.  CANCELLATION, REFUNDS & EXCHANGES

We want you to be totally satisfied with every purchase you make. It is our aim to offer you value & quality at outstandingly low prices. If, for any reason, you are not completely happy with your purchase, simply return it within 7 days of delivery, unused in its original packaging together with the receipt, to:

We'll gladly exchange or if you prefer offer a full refund (excluding carriage charges), if damage is deemed a fault of our own. EXCHANGES: we are happy to exchange goods if they are the incorrect size or colour. We will require an additional payment to cover the cost of sending out replacement/exchange goods & you will be responsible for returning the goods at your own expense. FAULTY or DAMAGED GOODS: we make every effort to ensure that goods ordered reach you in perfect condition, indeed every item is checked prior to dispatch. However, occasionally things do go wrong & if so we are happy to exchange faulty or damaged goods for an identical item. All faulty or damaged goods MUST be returned to us within 7 days. Goods returned outside this 7 day period (without prior arrangement) will not be accepted & will be returned to you. Faulty or damaged goods will be replaced with an identical item free of charge. REFUNDS: please note that there is a 15% handling & re-stocking charge on all orders that are non-refundable. Carriage charges are also non refundable. Applications for a refund must be made within 7 days of receiving your order. Refunds cannot be made until the goods have been returned. No exchanges or refunds will be made for ‘personalized’ items that have been subject to embroidery, lettering, screen printing etc, or items that have been ‘tailor made’ or items supplied by you including out size garments, one off colors & specifications. We are also unable to offer exchanges or refunds for certain goods on the grounds of hygiene including (but not exclusively): disposable items, socks, some footwear & certain items of PPE.

10.  REFUNDS

Any refund due will replicate the way your original payment was made. If payment for your order was made by credit/debit card, refunds will be made back to the same card. In the case of ‘Purchase Orders’ a credit note will be issued & subsequently accepted as payment towards any outstanding balance(s). Refunds are normally made within 5 working days of receiving you ‘returned’ item(s), however, please allow up to 28 days for it to be credited to your account.

We offer a print / embroidery only service whereby you can purchase the garments separately and then send them to us to be customised. When you use this service from us you understand that you’re sending the garments to us at your own risk. If they are lost in transit we will not be held responsible. You must track the delivery and handle any issues that arise in delivery.  We keep a keen eye on our quality control process, but, if you are supplying the products and there are problems with the print or damage to the garments due to the printing, that are not related to the print quality, we will not be held responsible for any of the cost of the garments / products.

We can’t guarantee 100% perfection on goods you supply. You accept up to a 25% spoilage rate where we will not be responsible for the cost of damage caused due to printing, embroidery or the customisation process. 

11.  PRODUCT INFORMATION:

“Screen Monkey” has made every effort to ensure details & information given in our on-line catalogue are correct at the time of publishing. Full technical specifications are not included & the Purchaser should check any details & information they wish to rely on with “Screen Monkey” at the time of purchase. The application & use of goods is the absolute responsibility of the “Purchaser”. “Screen Monkey” cannot accept liability in respect of any omissions or errors contained herein or for any loss, damage, consequential loss or malfunction arising from reliance upon our on-line catalogue. “Screen Monkey” reserves the right to alter any information & details as required. As we are continually trying to improve our product range, we reserve the right to provide an alternative product from those shown in our on-line catalogue. In such cases goods will be of the same standard & specification, & intended to serve the same purpose.

12.  INDEMNITY AGAINST INFRINGEMENT OF PATENTS & RIGHTS:

The “Purchaser” shall indemnify “Screen Monkey” against all damages, penalties, costs & expenses to which we may be liable as a result of goods supplied in accordance with the “Purchaser’s” specification which involves the infringement of any registered design, letter patents, intellectual property rights, proprietary process or otherwise.

13.  COLOUR REPRODUCTION:

Colour reproductions of goods featured in our on-line catalogue & color swatch are as accurate as the electronic process will allow & may vary slightly from those delivered. If in doubt please ask for a colour swatch.

14.  AMENDMENTS:

“Screen Monkey” reserves the right to amend its Terms & Conditions at any time & without giving prior notice.

15. GARMENT VARIATION:

  • Sizes may vary depending on colours selected.

  • Garment sizes are approximate and for guidance only.

  • Colour representation is only as accurate as the web design process allows.

16. PRINT COLOUR:

Any Pantone references provided will be matched as close as possible. There will be a variation within this as all colours are matched by eye using varied computer screens with different resolutions. No Pantones will be matched exact. 

18. PRINT POSITIONING:

All garments are printed individually and by hand. This means that the print position will vary from garment to garment. We do not use specific measurements for positioning. There will be some variation.

19. ARTWORK QUALITY:

We can only print as high quality as there artwork provided, if your artwork is not in a high enough resolution or is bitmapped, this is the way the design will be printed. “Screen Monkey’ have no responsibility to rectify poor quality artwork and will not be held accountable if the finished product if not up to standard when the artwork file is any less than 450dpi.

20.  JURISDICTION:

These terms & conditions shall be governed by & constructed in accordance with the laws of England & the “Purchaser” agrees to submit to the jurisdiction of the English Courts.
